Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Capritora SRL ("Redate", "Capritora"), a company registered in Belgium under enterprise number BE0786931405, with registered offices at 488 Chaussée de Louvain, 1380 Ohain, Belgium. These Terms govern your access to and use of the Redate.io platform ("Service"). By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as the Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree to these Terms, do not use the Service. These Terms are governed by Belgian law, including Book VI of the Belgian Code of Economic Law for consumer transactions, and comply with applicable European Union regulations including the General Data Protection Regulation (GDPR), the NIS2 Directive, and the EU Data Act.

Redate.io is a Software-as-a-Service (SaaS) platform that restores the original dates of emails that show the wrong date after a mailbox migration. During a migration, every email is copied into the new mailbox, and email clients such as Outlook, Gmail and Thunderbird then show the date of that copy instead of the original date, which the email still carries. The Service operates as follows: - Connect to your mailbox: with Google Workspace, with a Microsoft account (Outlook.com, Hotmail, Live or Microsoft 365), or with a direct IMAP connection. - Scan the mailbox to identify emails with a wrong date. - For each affected email: restore its original date. - Verify the corrected email to ensure data integrity. - Move the original email to a visible backup folder (not permanently deleted). The diagnostic scan is always free and does not require payment. The fix process is a paid service, charged per mailbox based on the number of emails to correct. Detection Methodology and Accuracy: Redate reads dates only, so the detection does not depend on which tool performed the migration. For every email it compares the date written by the sender (the Date: header) with the date your mailbox displays for that email, and it counts an email as affected when that email arrived during a migration. A migration gives itself away by its shape: at least five emails more than five days old landing in the mailbox within the same 24 hours, which ordinary delivery practically never produces, since a sending server gives up after four to five days. An email is counted when the date displayed is more than 15 minutes later than its Date: header and it arrived within 24 hours of such a moment. This is a method measured on real mailboxes, not a guarantee: on the mailboxes measured before it was adopted it counted no healthy email and missed no migrated one, but Redate does not warrant that every affected email is found, nor that no unaffected email is ever counted. Its known limits are these: a migration that moves fewer than five emails more than five days old within 24 hours is not recognised; an email genuinely delivered late within 24 hours of a migration can be counted although nothing is wrong with it; on Google Workspace, an email migrated without the delivery header that the correction removes is not detected. Each scan applies the method in force on the day it runs, and its result belongs to that scan. The earlier Microsoft 365 connector, closed to new connections on 13 September 2026 and withdrawn on 1 October 2026, keeps the previous method, which counts an email as soon as that difference exceeds 15 minutes. Whatever the method, the original email is always preserved in the backup folder, so an email corrected in error can be reviewed and restored.

To use the Service, you must create an account by providing accurate, current, and complete information. You agree to update your information promptly if it changes. You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify Redate immediately at hello@redate.io of any unauthorized use of your account or any other security breach. Redate reserves the right to refuse registration, suspend, or terminate any account at its sole discretion, particularly in cases of suspected fraud, abuse, or violation of these Terms.

Pricing is per mailbox, based on the number of emails to correct: 0.004 EUR per email flagged for correction, with a minimum of 29 EUR per mailbox. The exact price is calculated from the scan results and shown to you before any payment. All prices are displayed in euros (EUR) and exclude VAT. VAT is added at payment according to your billing country. Business clients (B2B) with a valid EU VAT number may benefit from the reverse charge mechanism (0% VAT) in accordance with the EU VAT Directive. Payment is processed exclusively through Stripe. Redate does not store credit card numbers or payment card data. Only order references and invoice links are retained. Stripe handles PCI DSS compliance for all card transactions. You are charged when you pay your order, before the correction starts; the correction itself starts only when you launch it. The diagnostic scan is always free. Redate reserves the right to modify pricing with 30 days' prior notice. Any price change will not affect orders already paid for.

Business clients: an order paid by a business client is not refundable. Private consumers: under Belgian consumer law (Book VI of the Code of Economic Law), you may withdraw from your order within 14 days of payment by writing to hello@redate.io with your order reference. - Correction not launched: the amount paid is refunded in full. - Correction in progress: Redate refunds the part of the price that corresponds to the emails not yet processed. - Correction completed: the right of withdrawal no longer applies once the service has been fully performed with your agreement (Article VI.53, 1°). Refunds are made within 14 days of your request, to the original payment method, via Stripe.

By using the Service, you explicitly authorize Redate to access your email mailbox for the sole purpose of scanning email headers and correcting email dates. This authorization constitutes your informed consent under GDPR Article 6(1)(a). Redate accesses email headers and metadata to identify affected emails. During the fix process, each email is temporarily processed in memory to correct its headers, then the corrected version is placed back in your mailbox. Email content is processed transiently and is never permanently stored on Redate's servers. Each email transits through Redate's infrastructure for seconds during processing, then is immediately discarded. Only metadata is retained: email counts, scan results, fix status, and timestamps, together with the subject line, the sender's display name and the dates of the emails actually corrected and of the sample shown in the scan results. This data is necessary for service delivery, reporting, support, and for undoing a correction. Email bodies and attachments are never kept. You represent and warrant that you have the legal authority to grant Redate access to the mailbox(es) you connect. If you are connecting mailboxes belonging to other users (e.g., as an IT administrator), you represent that you have obtained the necessary authorization from the mailbox owners or that you act under a lawful basis (such as employer authority) to do so. You may withdraw that access at any time, by the route that matches your connection. For a Microsoft connection, remove Redate at account.live.com/consent/Manage for a personal account (Outlook.com, Hotmail, Live, MSN), or at myapplications.microsoft.com for a work or school account. For a direct IMAP connection, change the mailbox password. For Google Workspace, and for Microsoft 365 connections made with the earlier connector (closed to new connections on 13 September 2026), remove the authorization from your own admin console (Google Admin, Microsoft Entra). To keep access exposure to a minimum, Redate limits how long it retains the means to reach your mailbox. For a direct IMAP connection, that is the mailbox password you provide; for a Microsoft connection, it is the pair of tokens Microsoft issues to Redate when you sign in. Redate erases both on its own: a daily pass removes them no sooner than 10 days after your last connection, and only while no scan or correction is running on that mailbox. Erasing the Microsoft tokens ends Redate's access to the mailbox without any action on your side. For Google Workspace, and for Microsoft 365 connections made with the earlier connector, access relies instead on an authorization you grant in your own admin console together with an application credential held by Redate; Redate cannot withdraw that authorization on your behalf. You remain solely responsible for revoking it in your admin console, following the instructions Redate provides in the application and by email. To the maximum extent permitted by applicable law, Redate declines responsibility for any consequence resulting from your failure to revoke an access that only you are able to revoke. Once access is no longer needed, Redate anonymizes the mailbox identifiers it holds (email address, domain, tenant, Microsoft account identifier), retaining only order and reporting records.

The Service, including its software, algorithms, user interface, documentation, branding, and all related intellectual property, is and remains the exclusive property of Capritora SRL. These Terms do not transfer any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms. You retain full ownership of your email data. Redate claims no ownership rights over the content of your emails or any data processed through the Service. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code of the Service, except where such restriction is prohibited by applicable law.

The Service is provided with documented precautions to prevent data loss and ensure reliable operation. Redate implements the following safety measures: (a) original emails are moved to a visible backup folder before modification, not permanently deleted; (b) the corrected copy is checked in the mailbox before the original is put away; on IMAP connections, including Microsoft connections, that check compares the copy against a fingerprint of the original taken before any change (its arrival date, its served size, a digest of its identity headers and a digest of its decoded content); (c) original emails remain recoverable in the backup folder for at least 30 days. To the maximum extent permitted by Belgian and EU law, Capritora SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of business, business interruption, or loss of goodwill, arising out of or in connection with the use of the Service. The total aggregate liability of Capritora SRL for any and all claims arising out of or in connection with the Service shall not exceed the amount actually paid by you for the specific service giving rise to the claim. Any claim arising from the use of the Service must be brought within twelve (12) months of the event giving rise to the claim. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) intentional acts or gross negligence (faute lourde); or (d) any other liability that cannot be excluded or limited under Belgian or EU law. You are solely responsible for maintaining independent backups of your email data. Redate strongly recommends that you maintain your own backups before initiating the fix process. Detection Accuracy Disclaimer: The detection of corrupted dates is a method measured on real mailboxes, described in Section 2, not a guarantee. Capritora SRL does not warrant that it finds every affected email, nor that it never counts an email that was not affected. The Customer acknowledges that both may occur and agrees that Capritora SRL shall not be liable for any consequences arising from the correction of emails that were incorrectly identified as affected, provided that the original email was preserved in the backup folder as described in the Service description.

You agree to indemnify, defend, and hold harmless Capritora SRL, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) your authorization of access to mailboxes for which you lack proper authority; or (e) any third-party claims related to your use of the Service. This indemnification obligation survives the termination of your account and these Terms.

Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond the reasonable control of the affected party, including but not limited to: natural disasters, war, terrorism, riots, epidemics or pandemics, government actions or orders, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (including email providers, hosting providers, and payment processors). The affected party shall notify the other party promptly and use reasonable efforts to mitigate the effects of the force majeure event. If the force majeure event continues for more than 90 consecutive days, either party may terminate the affected services without liability.

Redate uses reasonable efforts to ensure the Service is available and operational. However, the Service is provided without any uptime guarantee. Redate does not warrant that the Service will be uninterrupted, error-free, or available at all times. Scheduled maintenance will be performed during off-peak hours when possible. Redate may temporarily suspend the Service for maintenance, updates, or security reasons without prior notice in urgent cases. The Service depends on third-party providers (Google, Microsoft, IMAP servers, Render.com, Stripe) whose availability is outside of Redate's control. Redate shall not be liable for any interruptions caused by third-party service disruptions.

You may ask for your account to be deleted at any time by contacting Redate at hello@redate.io. Upon deletion, all your personal data will be permanently removed within 30 days, except for payment records retained for 10 years as required by Belgian accounting law. Redate reserves the right to suspend or terminate accounts that: (a) violate these Terms; (b) engage in abusive, fraudulent, or illegal behavior; (c) attempt to compromise the security or integrity of the Service; or (d) remain inactive for more than 24 months. In compliance with the EU Data Act (applicable from September 2025), you have the right to: (a) terminate your use of the Service with a notice period of no more than 2 months; and (b) request the export of all your data in a structured, commonly used, machine-readable format within 30 days of termination. To exercise your data export right, contact Redate at hello@redate.io. Upon termination, your access to the Service will cease immediately. Any outstanding payment obligations remain due.

Redate reserves the right to modify these Terms at any time. Material changes will be communicated to you by email and/or by a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after the effective date of the modified Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must stop using the Service before the changes take effect; you may ask for your account to be deleted by writing to hello@redate.io. Non-material changes (such as formatting, clarifications, or corrections that do not affect your rights or obligations) may be made without prior notice.

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. For B2B customers, any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Brussels, Belgium. For B2C customers (consumers), this choice of jurisdiction does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence, in accordance with Regulation (EC) No 593/2008 (Rome I). You may also bring proceedings in the courts of your country of habitual residence. Before initiating legal proceedings, the parties agree to attempt to resolve disputes amicably by contacting Redate at hello@redate.io. The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent and economic effect of the invalid provision.

These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and (where applicable) the Data Processing Agreement, constitute the entire agreement between you and Capritora SRL regarding the use of the Service. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Redate regarding the Service. No waiver of any provision of these Terms shall be effective unless in writing and signed by Capritora SRL. A failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
